"To "sell short" is quite legal and legitimate, but a "bear raid" can easily cross the border into a clear-cut violation of Section 10 of the Securities Exchange Act of 1934, and specifically of Rule 10b-5. "Employment of Manipulative and Deceptive Devices."

I must do more research on Securities Law to find out the answer.
