Pancho,
Any idea when this cool down and tanks? Are they going to have secondary to raise cash? or else? Do they have insider selling currently? Should have got out 1/2 couple days ago and reshort when it is higher and weaker but who knows.
Good luck
Should alert bear funds for this. Also about the coming suit, will it happen soon?

I'm short at 26 1/8.

I think we might want to be proactive on this one, as long as we are careful to always use terms such as: "in my opinion"; "allegedly"; etc.

The mutual funds could be contacted and notified that there seem to be a significant number of disgruntled customers, based on the Internet website that you have referenced. They should also be notified of the Connecticut class action.

Research could be commenced to see whether other states have statutes regarding multi-year contracts, which which Bally may not be in total conformance.

The people with alleged complaints regarding deceptive "bait and switch" sales practices; false representation of contracts; sexual harassment; poor service; systematic intimidation through bad credit reports, should be encouraged to mail copies of their complaints and all supporting documentation to the attorneys general of the associated states. I have found that the offices of attorneys general are usually very helpful with correcting individual consumer complaints, and if these complaints are indeed legitimate, and seem to constitute a trend, they may take much more significant action. This action could include fines, civil or criminal charges, revocation of business licenses, etc.

(The states may also investigate by sending undercover agents to the clubs to attempt to verify or refute the consumers' allegations.)

Note: I have no proof that BFIT is doing anything improper, and do not intend to suggest that is the case.
