Yes. I paraphrased from it. Suit "pending since the termination of the Andersons..."

My point was: Why did MDCE need information from a DFNL lawsuit (filed February 27) in order to file their own lawsuit against DFNL? If the alleged Anderson improprieties did occur, wouldn't MDCE have plenty of fodder for their suit PRIOR to the DFNL filing?

The explanation of the time lag between the DFNL lawsuit and the release regarding the MDCE lawsuit seems feeble. A more accurate reason might be retaliation against the DFNL principals.
