Novell Investors The class actions filed by Milberg Weiss Bershad Hynes & Lerach LLP are being driven by William Lerach who's name is included in the Milberg, Weiss,etc,etc. firm name. Mr. Lerach is no ordinary attorney and deserves proper respect. He does not charge hourly fees but works solely on contingency which might suggest his confidence of his ability to extract a few dollars from opponents coffers. His reputation is widely known and is said to be the top attorney in the country dealing with shareholder class actions against corporations.(Listed on Forbes Magazine top 10 attorneys etc.) He is feared by Corporate management far and wide with press reviews of past years describing him as vicious, ruthless, scheeming and a list of other unflatering terms. When I said that he deserved respect I ment that if Mr. Lerach comes a Knocking at your door you better have a loaded gun in hand and the hammer cocked, he isn't over to sit and chat. It would be well advised that anyone with an interest in the future of Novell should read these two complaints paying attention to the excruciating detail that has been incorporated. (Print them out and use a highlighter, you'll be refering to them again in the near future.) After reading them refer back to SI on this thread to comments made by Salah, Joe, Vinod, Steve and others begining in mid 1996 forward. No one will have to tell you that these lawsuits have merit, you will know for yourself that they have merit because many of the claims made are evident from the past two years of discussion on this very thread. I will tell you that I have witnessed many, many of Novell's activities alleged in reference to channel stuffing and gray market activity first hand and may be required to testify accordingly. I can tell you that "most" of these allegations will turn out to be true in spades and these facts are the very basis of the "book cooking" charges. Also, the periods for the actions could well be expanded back to as early as 1993 and possibly mid 1992. Again, I saw it that far back personally. As for the security issues, you might consider reading that case when you try to figure out the strange trading patterns for NOVL. Hmmm.. Mr. Lerach is "not" wasting his time. He makes big money doing what nobody does better and is working for another payday. I think that the 1 Billion in cash has finally attracted some interest, but not an offer to buy. Oh, and expect to see some "anti-trust" suits to arise from the depositions on the horizion. These two suits were filed in California and the timing may vary somewhat but I would expect it to be comperable. Also realize that Novell will have to fight these suits in California where nobody cares "who" they "used" to be, unlike in Utah.
