My previous post assumed incorrectly that Lev would be taxed on this transaction. I got my exercise today of jumping to conclusions as one poster here said. Here is another spin and I have not seen anyone pick up on this. I read the 13D after my post. I understand Lev had until 3/31/98 in which to exercise this option. If he believed the stock was going to tank I do not think he would have exercised the option. He has pledged a note plus some of his other shares. So isn't the risk more with pledging the shares of stock that he already owns.
