I emailed Scott RE: 'out of stock' situation, asking him to clarify:

David,

What he is saying is that there is very little available stock to buy
-- legitimate holdings or someone willing to go short. I believe the
reason for his conclusion, and we here at Banyan are following this
closely, is that a number of individual investors have been having
unusual delays (an hour or more) at getting fills for buy orders at
the ask price. Market makers are reluctant to raise the ask, but
they don't have enough inventory to quickly fill the order either.
Hence, they are sitting on the orders hoping someone will sell some
stock so they can fill the open orders.

The market is very tight right now and could get even tighter next
week. I'm going to have lunch with Cameron this afternoon and will
discuss this further with him. On top of that, I am aware that
several investors have made recent complaints to the SEC so it is
very possible that a long overdue informal investigation could be
launched sometime soon.

I hope this helps shed a little light on this situation. If you
would like further explanation, please let me know.
