It seems to be perfectly legal for HP to create it's own Java since they had no agreement with Sun.
This smells like trouble long term, IMHO.

-- Hewlett-Packard Co (HWP - news) is to announce plans to market its own variant of Java software, breaking
with Sun Microsystems Inc (SUNW - news), the Wall Street Journal reported. It said Hewlett-Packard would
now compete with Sun, the creator of Java, and had signed a deal with Microsoft Corp (MSFT - news).
Hewlett-Packard closed at 63 on Thursday.
