The legality issue doesn't change. HP created their own implementation, but didn't alter the specification. Microsoft has their own 'clean-room' version of Java, anyway.

Because they don't want it to run everywhere. They are trying to stop SUNW from implementing JAVA in a way that is not in their interests. Also, MSFT wants to be associated with JAVA. It looks bad when a software company isn't associated with the hottest programming language.

See, today Apple just mentioned the word Java and shares rise $2 =)
Doubt that is the only reason, but thought it was amusing.
