An open question on cloning Intel's MMX2.

Suppose AMD were to buy S3, gaining foothold in graphics market as well as patent portfolio. S3 also probably has another valuable commoditiy, the knowledge of Intel's future MMX2 intruction set to be used in the "Katmai" processor (1999?). (Intel announced that they would be disclosing it to selected developers, and I would assume that a graphics chip mfgr would be one of the first to know.)

My question is, if AMD purchased S3 couldn't S3 disclose the MMX2 instruction set to themselves (AMD) with impunity?
