It really doesn't look like FSCX can pay the debt. My understanding is that the plaintiffs judgement is subordinated to the lenders. Vendors, bond holders, and even the paper boy. Accounting is such a great weapon in these sorts of things. The bean counters can make it look like anything they want. And it doesn't look like they would have to stretch the truth very far to show FSCX's inability to pay the current judgement amount.
Maybe an attorney that knows about these things might enlighten us over the weekend.
