That lawsuit is a joke. Now everyone and their sleazy lawyer will be jumping on the bandwagon.

"I paid $2,000 per eye instead of maybe $1,850..."

Yes, but how's your vision now? Even if PPP didn't exist, the docs, who are the ones who need to make the big money off of LVC, still could have charged $2,000 per eye, and kept the extra $150. The market is willing to pay $2,000 per eye, and no one is forcing them to do LVC, which, after all, is ELECTIVE surgery.

In all the FTC hysteria, don't forget Visx just got approved for "no-touch" PRK on their newly-approved scanning laser, the STAR S2.

7 scanning beams do the job as smoothly and faster than all those scanning+eyetracking systems going through approval now, supposedly.
This gives Visx another marketing edge over Summit, and another barrier to entry against the upcoming systems.

Judge in April will say, "Visx, do you have your lawyers ready? Summit, do you have your lawyers ready? You both plead innocent? Then your rumble date with FTC is set for next year. Besides, this patent stuff is in the domain of the PTO."

Then, Q1 earnings will come out, up over 150% from year ago, and stock will hit $35, as all the shorts freak out over their misguided behavior. Oh, and the class action will fail too.
