Kemess Mines, the flagship project of Peggy Witte's Royal Oak Mines, has
scored a court win upholding its injunction against native road blockades.
In a decision released Friday in Vancouver, BC Supreme Court Justice
William Grist dismissed a legal challenge by the Tsay Key Dene Indian band
to an injunction granted last June. "The road is the only land access to a
large industrial development and the plaintiff (Kemess) will undoubtedly
suffer extensive losses through delay or the prohibitive costs of alternate
transport," stated the judge in a 14-page decision. The court ruling was
the second piece of good news in as many days for Royal Oak, which
disclosed a crucial US$120 million survival financing on Wednesday to carry
Kemess through production.
