If the rumors are true, my guess is that it must have been part of the licensing deal back in August. We still haven't seen all of the fruits of that deal, so it's entirely possible that yellow box was part of it. In other words, yes, Apple can charge for the license, and it received payment already as part of the $150M investment. Whether or not it can charge ongoing fees would depend on the deal. My guess is that the deal stipulated no ongoing fees, as I'm sure Microsoft wouldn't want the cost of every copy of its OS to contain a fee to Apple.

That yellow box rumor, if it turns out to be true, would be the best possible thing for Apple. It would almost guarantee the success of Rhapsody and, with it, the MacOS. The only danger I see in it is that Microsoft seems to have control of the yellow box APIs, and could do to them what it has done to Java, i.e. pervert them in order to break Rhapsody's cross-platform capabilities. I don't think we can know for sure what's going on until we hear something official from Apple and Microsoft.
