As a lawyer who helps people avoid estate tax, i can tell you that not only are estate taxes pointless in theory, but they are pointless in practice. For all intents and purposes, the estate tax is a voluntary tax. With all the magic a good tax attorney can come up with, the only people paying estate tax are those who are too foolish not to do some planning. So I can tell you that we will have two classes based on those who hire lawyers to skirt the tax and those shmageggis who do not and pay.
