We can call them but they do not have to say anything until after the merger (they are a private company).

You are more apt to screw things up if you do. Companies don't like it when outsiders get involved with business negotiations. Even if they are polite they will probably tell you it's none of your business (which it isn't). You are not an officer of either co.
