I'd ask both IMTI and Theragenics (note 800 number)......
theragenics.com

about patents. Theragenics' efforts are highly respected, and a search for U.S. patents turned up this....
patents.ibm.com

A search for IMAGYN turned up tons of patents, but nothing relating to radioactive seeds or prostate. This does NOT mean that they don't have a proprietary stance. It just means that I didn't find one.

I'm certain that you know about this, which appeared the day after your note (I just found it, however).......
fnews.yahoo.com

I noticed that IMAGYN talks about palladium *and* iodine, a gamma emitter. All of the Theragenics patents address only palladium and X-rays. If this is a practical route around the effective Theragenics/JNJ alliance, I don't see it. Hopefully IR at IMTI will.

Cheers! Rick
