The "true" response rate can never be known, without testing an infinite number of patients. That's why they use confidence intervals. If someone tells you they have a drug with a "true" response rate of 80%, with no margin for error, run.

Having said that, there's a big difference between 18 and 41, and a roughly 1 in 40 chance that the response rate is less than 18. And, I pretty much agree with your other comments.
