Wave sued Infosafe in 1994, not vice versa. From the description in the 1996 Annual Report (very dated source--June, 1997), I would surmise Infosafe was formed by prior Wave employee(s) who appear to have allegedly misappropriated Wave trade secrets and other confidential materials.

Infosafe counterclaimed for tortious interference with business and financial relationships. Both because of the theory of recovery (an amorphous can't-come-up-with-anything-better type of claim) and the fact it was not asserted by Infosafe except as a litigation counterpunch, I'd suspect it's weak. No apparent patent claims going either direction from my reading of the Wave Annual Report.

I have no knowledge of the litigation, whether there has been other litigation commenced since June 1997, or whether any litigation is even still pending.

Wahoograd--you hinted at developments in May. Is this the season for new product announcements by box-makers, or are you thinking of something more specific to WAVX, with or without IBM? I'm thinking there has to be April news around the corner unless we're seeing belated reaction to the Lark Allen move, with its very strongly implied vote of confidence in WAVX.

TA remains very strong: Rising price on increasing volume with repeated closes at or near the high of the day. 50-day moving average is about to cross over the 200-day moving average (on the rise, of course). Tomorrow we likely test resistance in the $2.00 arena and maybe the apparent 52-week high of about $2.15 or so.
If we go through and hold, I'd clutch onto all my shares with both hands.
