Marvin,

To date, ERICY has resisted making a deal with QCOM that would allow them to make IS-95 compliant hardware without a patent lawsuit. It's a long a convoluted story, but IMHO the bottom line is that ERICY is making a concentrated effort to promote the life of it's GSM & TDMA lines of hardware, and doesn't want to support the IS-95 CDMA systems.

In parallel, ERICY is partnering with a number of other companies to develop W-CDMA, which may or may not require a similar licensing agreement with the Q. This is an unstated endorsement by ERICY of CDMA technology as the basis for future wideband systems, but to date they are still developing their hardware without any QCOM agreements. ERICY also has stated in the past that they have important IPR for CDMA, which QCOM has pooh-poohed... ergo the upcoming trial.

All of this causes QCOM backers to get very tightly wound and defensive, since an ERICY agreement would give QCOM systems a great boost in terms of credibility (although in my opinion they've got plenty without it...) and remove a lot of investor's uncertainties regarding QCOM's future.

I think your mom listened to some bad advice, but that's just my opinion...

Marvin- Ericy has no cdma license to sell land based cdma systems which the world agrees is superior to GSM. The problem is no one wants to pay qcom the $. However if cdma is better and cheaper (including royalties) than GSM, then it would seem that more new wireless business would go to cdma.

My bet though is ercicy's not stupid and gets a license for land based cdma before the end of this year. Hey Daniel you want to make a bet?
