Not to defend the ossifers of CMYN and their decision to float a death spiral convertible, but at the time of those statements, they were correct. It wasn't until the stock went below a certain price that the convertibles added fuel to the fire. I believe it was driven down to that level by a combination of shorts and especially panic over declining gold prices and instability in Zimbabwe. But issuing the convertible after 18 years of a gold bear market was tantamount to buying a home on a flood plain with no flood insurance after 18 days of rain.
