Yeah, there's a lot of us who agree. However, they have done certain things well and have beaten expectations in certain areas and this never gets much air time, for instance the ramp up of the original Paco plant. Also, this will be the first full quarter that the new Veep of Operations has been on board- maybe that will help things along (see the following link for this December announcement if you care: vivus.com You could argue that they recognized their operations weakness (Doh!) and took steps to resolve it.

Personally I don't really give a hoot about the law suits. They're just a nuisance and distraction, nothing more. the company does have hurdles, but these silly law suits are, IMO, just an irritating side show, nothing more.

Tell me how you really feel about your vivus investment. I would say that currently 99.9% of the longs are losing money. Just because you don't have a paper or realized gain doesn't mean that things won't pan out in the end. It just depends on exactly where your investing endpoints are. It would be nice for all of us to have large paper or realized gains RIGHT NOW but that is not how investing in the market works. If you can't take the heat get out of the kitchen or never enter the kitchen in the first place. Our ship has already sunk. The question is: Can they raise the Titanic? I think so but it will take time.
