Unfortunately, there is no favorable capital gains rate for shorts--it is all short term gains no matter how long the short position is held before covered.

I guess the convoluted IRS thinking is that if you bought today (covered a short position) that you never "held" the stock at all--in fact if you sold it last Feb, you would have a -14 month holding period.

there is no "holding period" for covering shorts.

all gains from short sales are considered short-term gains,
no matter how long the position is open.

David: I think, in my opinion only, that it goes without saying that unless VVUS earns over 4 cents a share, it won't matter, from a long's perspective, what they report tomorrow. At best, only a blip up can be hoped for. On the other hand, if earnings are less than the consensus, it could be bloody. For the long term, I, in my opinion,I do not believe they will meet any of the analysist's projections. I would not be at all surprised if they showed a loss for the entire year.

Again, only my opinion.
