Dear KA - you're welcome. I agree with you that EXSO saw the delisting coming. Official notice said mgt was surprise, but I didn't see it as outright lie [to investors] however. I'd guess it was an last ditch effort to plea bargain [without any leverage] with them NAZ bureaucrats. It is just a confluence of factors. Maybe in the wild west days, it could convince NAZ for a stay of execution, but NAZ had an image to fix itself! Still, like you said, that doesn't excuse EXSO mgt.

Since you have been in and out of EXSO for 2 yrs, I am sure you are well aware of the Reg S problems. In a way, you are right, APS probably has had no intention to see EXSO to go under, but I am not sure about the bandits: if they have already reclaimed much of their original Reg S investment, they might very well sit on the shorts until the co rolled over. Mind you, before they were exposed, they were - still are - both shareholders and creditors. Somewhat related, this convertible issue has essentially tied EXSO mgt from preventing delisting by way of reverse split, knowing well such an effort might remove one of the weapons in its arsenal against the bandits - by law they cannot issue more shares. I have seen companies treating the regular common shareholders far worse - by way of reverse split to appease the bandits. Of course, now that the bandits are exposed, they are less willing to take down the co without attracting attention from SEC. So, we have a mexican standoff!

I think hintsight is 20/20. It is easy to say that they should deal with the debt before it was out-of-hand, but it is not as easy to crawl out of the burden when it started to weigh on the co. It is said that for it only takes mgt not to make any mistake for the co to be successful.

Ultimately, I'd agree with your skepticism, EXSO is still very much kneedeep in Kim Chee <VBG>.
