Daytrader's tax treatment, Urgent help needed

It's tax season. Does anyone has any info or where to find info regarding how a daytrader is treated in tax law? I have two specific questions: first, whether the buying and selling in short term is considered "in the ordinary course of business" of the day trader; second, can the day trader treat his gain as business gain rather than capital gain?

Any info will be welcome and I will not hold you as giving tax advice. That is to say, I will not follow your advice directly, although I may, after due consideration.
