look at the chart from last December.

it spent a lot of time at 10 before it went to 15.

why didn't they buy at 10?

please pardon me for belaboring this point.

VVUS had that CC in mid-December where they announced
that they were going to be buying back shares in Q1.

so let's consider a hypothetical where you have your
investments under professional management, and you
went to yr money manager on 12/15/97 after listening to the
CC and said "i want to buy VVUS, get me in."

then, money manager takes his sweet time looking at it,
and buys you your shares at $14.75.

and they delay sending you your account statement until
today, with the stock at 10.

wouldn't you be upset?, and wouldn't you consider calling
yr lawyer?

co. management has a fiduciary duty to shareholders,
just the same as that hypothetical money manager.

they squandered *our* funds supporting the stock
at its near-term high.
