Yeah - good point. I understand how it could seem inconsistent. Unfortunately, I wasn't clear enough. I think you see how the sexy waitress spitting activity is actually sort of an undocumented feature. The "pesky health department problems" actually referred to the health department itself. As you no doubt could infer from my list of hobbies, and from Chuck's assessment of me as an uncaring human being, I personally wouldn't care about any sanitation or health situations created in my hypothetical restaurant. But since that annoying health department would stop by from time-to-time, and insist on making me keep the place clean and sanitary, against my free will, and against all of my freedom of choice as an American (god bless!), I don't know if the culinary industry would be for me. In fact, now that I consider it, that health department is, in effect, imposing unauthorized taxes (i.e. the cost of keeping the place clean). Hope this clears it up.
