Tell me if I'm wrong. The problem resulted from the attempt by one company to pursue the business of manufacturing lasers without infringing on patents held by the other company. This conflict constantly provoked legal confrontations. Visx and Summit invented PPP to stop the constant litigation (and lawyer fees), and as they claimed, to allow competition based on cost and quality of product.
I still think that is the situation. I still think you can't separate the patent contents.
Is the FED now able to jump over a patent right to an "elective surgery", and release those rights to others? I'm sure a few people will have a few thoughts on that question.
Beam would be crazy if they did not take the FTC to the Supreme Court
if they tried to neutralize any rights inherent in the patents they hold. They should make the FTC show a reasonable plan to allow each company to collect the R&D expensed. Also, while the court decides, I'm sure the royalties should continue to be collected under PPP.
