I just realized that I didn't make my point/question clear previously. It is quite apparent that MSFT is not ready for real time. I guess my question is more legal than technical.

One can argue that MSFT already has product liability problems. The fact that Windows crashes frequently may suggest that they sold me a defective product that does not work as promised. Losing a few hours of work is not severe enough to make me call my lawyer. If my car crashes frequently because of a MSFT (deep pocket) product, would there be class action suits of the magnitude of breast implants or asbestos?

How about if MSFT comes up with some RTOS and sold the product to developers. After spending hundreds of hours, the developer found out that this kind of real time product would not meet real time demands. Is MSFT liable for loss of the developer's R&D time?

Am I overstating the potential difference between a regular OS vs RT?
