I was always aware that Summit had more patents registered than Visx. Also, having followed the litigation for many years, I could not remember at any time when BEAM lost a patent fight in or out of the USA. With no real grasp on the technical value of the patents however, I still leave it to the technicians to determine which patents are more valuable.
Now that the FTC is questioning some of the patent positions of VISX, one must ask what will be the strength of their patent portfolio if the FED rules against them? Can you break up and determine separate values for the rights of Summit and Visx , and charge new machine manufacturers accordingly? What will be the ratios of royalties after the Fed decisions? Anyone here have any comments?
