If the spread is 1/16 or less, my understanding is that in that situation, you can then short a 1/32 higher, thus not the 1/16 above required on downbid. Call the NASD's legal department and ask quite simply for a clarification. Then go to Schwab with the person's name at the NASD. THAT is the best ammo you can get....... Nothing else will work....
