David, I am not Joe but since part of your confusion appears to stem from one of my posts will attempt to answer your questions. As I understand things:

Our "non" friend, shorted 700,000 shares against his restricted holdings. In my view, if someone is "preselling" shares they expect to have free in the future, they are in effect a "seller" not a "shorter". My perception of a shorter is someone that sells a stock with the anticipation of it dropping so that they can buy it later at a lower cost to make a profit and it is my impression that this is not the case. I know that when you short in the US, you are required to keep an amount of value in either equity or cash to cover your outstanding short position. My question is could someone legally use restricted shares to meet that requirement? And then of course I also don't know if the rules concerning coverage are different in Canada. Perhaps Joe Medsker can answer the rest of our questions.
