Steve1, The answer to this question about whether DCTC shares can be loaned out of a margin account seems to be getting ever more complex. Here is a post that Brad sent to me via email: (Thanks for forwarding this to us Brad)

Brad, there has been lots of discussion on SI about margined accounts
and whether DCTC can be loaned out of these accounts. I just called my
broker and nailed him down. Though I have them in a global margin
account, those particular shares are, within that margin account, in
something called a "TYPE 1" which is a cash only holding within the
margin account. I HOWEVER MUST REQUEST that the shares not be loaned
out. Please see that this info gets to someone who can post on SI as I
know you are on Hiatus <g>.

I just called one of my own brokers (DLJ) and asked about the process required to request that my shares not be loaned out. According to the person I talked to and the person he in turn asked, nothing had to be done to prevent the loaning of my shares since the DCTC I owned was already in my cash account since it was not marginable. Somehow I have the feeling that a MM for DLJ could still get to them, but I am beginning to doubt that they could be used to help Mr. X cover his 700K short.
