Which comes across as even more favorable to Bill. Dan, I would not attach too much significance to oral argument as a predictor of the outcome. Sometimes Judges ask you questions because they disagree with you and want to see if you have anything at all to support your position. Other times, they ask because they want you to validate their thinking. It's often awfully hard to tell which is which. If Microsoft spins this too hard, it could prove VERY embarrassing.
