Jules -
Intel never had exclusive rights - samsung was already a second source and fab discussions with AMD and IBM were ongoing since early 97 and have continued. There is nothing new in the ftc declaration except the spin that somehow the government was involved in pushing for these additional arrangements. My understanding is that the pre-sold language is more of a buyer-seller contract.
