You can always take your business elsewhere. Datek has its own agendas and unfortunately people complaining on the internet isn't going to change that. Regarding the recent "technical difficulties"- I'm sure they are told by their lawyers not to admit to any wrongdoings for fear of setting any precedents. Once it's stated that they're not responsible for any losses due to technical difficulties, they're not required by law to reimburse anyone. It may be morally wrong, but that's business.
