All this nonsense about how Nidek, LaserSight, and others will undermine the per-procedure fee by charging, perhaps, NO fees (MrGeneral on Yahoo board) misses one important fact: The only way for the manufacturer/patent holder to make money is to charge fees for use. It's a cost of doing business for the centers. ALL manufacturers will charge procedure royalties in U.S. and Japan, the two biggest markets in the world in the near-term. Nidek, Autonomous, Visx, everyone. People need to quit fantasizing about the end of procedure fees. It won't happen in the major markets. And these lawsuits are just last-ditch effort money-grabs by people with nothing to lose. Besides, Summit and Visx are "deep-pockets" now, and all this FTC nonsense is giving these yahoo's the green light to stomp on the lawsuit accelerator while time is still ripe.
