I think this is a problem with the entire US legal system and has nothing to do with Microsoft. The little guy is always at a disadvantage when going up against anyone with deep pockets. Microsoft was used here as a specific example, but in reality, any wealthy entity can be substituted.

Personally, I like how it is in Japan: Loser pays all the legal bills. This ensures that only credible lawsuits are brought in the first place (ie., it also takes out all the frivolous garbage that clogs our court system).
