Ballard, like most dynamic technology companies, does not have "a technology". They are in motion with respect to their intellectual property. Off the top of my head (maybe Hawkeye or someone can provide the actual numbers) Ballard has been applying for new patents at a rate of roughly 40-50 per year. This has accelerated in the last few years, so the current status is approx 250 patents granted or pending, most of them recent. In a field that is developing so rapidly, Ballard's patent protection should easily outlive the current technology. In 10 years, Ballard will have many new patents, covering the "next-generations" of fuel cell technology.

One thing that I believe carries a lot of weight regarding Ballard's Annual Report is management's stellar record of making good on their clearly stated objectives. They have built a great deal of credibility for themselves by being very direct and up front with their aggressive plans, targets, etc. and then consistently delivering on them.
