phbolton -- It all depends on your situation. I have left profits slip away in the past. I take some profits and keep watching and waiting for more profits.

I believe it's when it's declared substantially worthless by the Dept of the Treasury. It may be some other agency, but there has to be a declaration by the powers that be. IDID is still trading, 9200 shares have crossed today at $0.005. IDID should be the poster child for substantially worthless. I think as long as it trades with some kind of price, you can avoid the tax.
