Amen. Palmisano is the one that gave the clue. He stated in yesterdays earnings announcement that Visx is incorrect in their assumption and it contradicts their own 1996 10K. Boy, sure enough, I went and reviewed it and there it was. There was more, but no sense in rubbing it in. As a government employee, I know the power of a contractual agreement and unless there is a "meetings of minds", to amend it or void it, the agreement is as strong as steel. That's the purpose behind an agreement (to protect the participants of the agreement). Not only does VISX do the opposite of its own statements, it does it without ever first attempting to resolve their interpretation with the other partner (which also was a violation of the PPP agreement).
