The sellers were banging away today. I thought of covering at 4 13/16 because there were ~14000 being bid at 3 3/4, and volume was ~50k. I looked back 10 minutes later and 4 3/4 had been taken out. Most encouraging, especially considering today was rally day on Wall Street.

This is the key condition:

(v) On each day during the period beginning 20 days prior
to the Put Notice Date and ending on and including the Put Closing
Date, the Market Price for shares of Common Stock (as defined in the
Certificate of Designations) shall not be less than $6.00 (subject to
appropriate adjustment in the event of any stock dividend, stock
split, combination or other similar recapitalization affecting such
Shares).

The way I read the 8-K Panda can "put" the shares 60 days after the registration for the original shares becomes effective.
