I think the more important point is the approval of the Primestar/AskyB merger. Murdoch is not about to settle a lawsuit that is based on a not so iron clad agreement to merge. Lawsuits of this type can last between 3 and 7 years. I would not bet on anything over the near term related to this litigation. Murdoch isn't stupid, he found a loophole that got him out of the agreement and he took it. Ergen is mad because he was betting on News Corp. capital. He lost his finacing and then his deal went to the competitor that could do the most damage in grabbing new market share.
