The FDA has tons of comments to sort out before they issue their Final Rule. The Administrative Procedures Act requires that they give due consideration to each and every comment, pro or con.

Sometimes rulemakings end up being delayed if new information becomes available, or the agency is just having too hard of a time in sorting it all out. There have been many such near-dead rulemakings from the EPA for example, on cleanup standards for radiation sites. Some of these rulemakings have dragged on for 20 years, or more.

If you or I disagree with the usefulness of whatever definition FDA comes up with, we can choose to ignore it. If it's really a worthless definition from FDA after all, then the organic industry could set up its own standards, but don't they already have that?
