If a company does not collect sales tax from you, you are still responsible for the tax.
In fact, this whole issue became a "gold mine" for State Revenue Departments.
You might not think they will go after individuals on this, but they do go after businesses on this. Since you are responsible for the tax, they can also levy penalties against you.
The idea of what constitutes a "physical presence" is also a very grey area.
Most large companies that sell out of state charge sales tax for that state just to avoid the potential problem.
If you order a computer from Dell, they will charge tax. Most of the mail order companies I order from do charge tax. Amazon has set themselves up for a potentially huge tax liability by not collecting the tax. I also doubt that Amazon informs their customers that they are responsible for paying the tax that they didn't collect.

Bill, I think us Amzn bears, are just hanging around here sharing our negative thoughts. There must still be some Amzn bulls out there, unless they all have retired to Monte Carlo.
I sure would like to get their thoughts. After all Amzn is only 5 1/2 points off its all time high.
Amzn bulls please join in.

Does bankruptcy get a company out of state sales tax obligations ??
Just a (devious) thought.

William,

Bankruptcy will relieve obligation to private creditors. Taxes remain due.
