In regards to Sales Tax and "physical presence": In Illinois , physical presence doesn't mean having a physical location in the state. They can, and have made companies liable because they had trucks in the state, employees in the state, or conduct business in the state at any time.
That is why it would make more sense for companies like Amazon or Barnes and Noble to collect the tax. By not doing so, they leave themselves open to huge liabilities. And as I stated earlier, the customer is still liable for the sales tax... so why not just collect it. In my state, Illinois, if you don't file the sales tax return, that means there is no statue of limitations. In other words, a company can be found liable 10 years later and be forced to pay the sales tax along with penalty and interest.
