I think you are right on E-trade but like the man said "We are a small outfit".Unless things have changed with the "Big boys" I think that you will find that when you sign your application you are allowing them to use your shares for shorting. It would take too much time to call everybody when some one wants to "Short" in order to verify that it is alright.

Some time ago I received a letter from a large Brokerage asking me if it was okay to let Corporations etc know if I held shares and how many in any given Corporation. If I didnt want anyone to know I could sign a letter stating such. Several Brokerages later not one has asked me that question which probably means that they send the letter out when the Law is passed and then do what they want anyway down the road.

A bank is supposed to Verify your signature on a check before they cash it. When was the last time anybody was asked for ID etc.
