Not meant to be a scare...just placing a thought out for pondering:

Is it possible that LaJolla is selling the shares slowly, in small chunks whenever the price reaches the .40 level? That way, they can maximize the revenue for the company without spooking the investors.
I don't know how this sort of thing is usually done.
When my company (UVN) offered more shares into the float, they found major investors to buy chunks of it, then UVN supported the price for a period of time. Clearly, different rules apply to the BB's.
