Microsoft expects Sun to sue over Windows 98

SEATTLE, May 12 (Reuters) - Microsoft Corp.(MSFT - news).
officials said Tuesday they expect rival Sun Microsystems Inc.
(SUNW - news) o file a lawsuit seeking to block the shipment of the
forthcoming Windows 98 operating system.

Tod Nielsen, manager of developer relations, said Microsoft remained
confident it would ship Windows 98 to computer manufacturers as
planned this Friday for retail sale beginning June 25.


Sun officials could not immediately be reached for comment.

Nielsen said Microsoft was informed of the looming action Monday
night by Sun executives, who said the request to block Windows 98
would be related to a lawsuit filed last fall over Microsoft's use
of the Java programming code.

Microsoft has a licensing agreement with Sun to use Java in its
products, but Sun has argued in court that Microsoft's implementation
of Java in products including the Internet Explorer 4.0 browser is
not compatible with the licensing requirements.

But Nielsen said the licensing agreement specifically bars Sun from
seeking a court injunction against Microsoft, and he pointed out
that Sun has never tried to stop shipment of Internet Explorer 4.0
despite the dispute between the two companies.
