Are you thinking about the ESTs? whether ESTs will be allowed by the US PTO, and what scope they will be given by the courts later on?

Word is that for several years now the Patent office has a special room dedicated to holding INCY filings. The EST filings are huge. Some time back the PTO was complaining about how the fees charged don't come near covering the costs of processing these patent applications. INCY has had an in-house patent group in excess of 20 people since at least 1995. In short, yes they have patents, they have applications and they will ultimately defend them.

Per INCY CEO Roy Whitfield at the 1997 annual meeting:
