A federal appeals court ruled Tuesday that antitrust restrictions a judge placed on the sale of Microsoft Corp.'s Windows software don't extend to the upcoming release of Windows 98, the company said.

The decision means that, barring further action by the Justice Department, the company can ship its updated Windows software, Windows 98, this week and require computer makers to include Microsoft's Web browser.

Even a week ago, the decision would have been seen as a major victory for Microsoft in its struggle with government regulators. But given events this week, the news is likely to soon be little more than a footnote in that battle. That's because further action by the Justice Department is now seen as a virtual certainty -- the department and a group of states investigating Microsoft are expected to file a broad antitrust complaint this week that still could interfere with that shipment.
